2. Data transfer to third countries
Herzhaus Studios LLC has its registered office in the United States. When you visit this website and contact us, data may be processed on servers outside the European Union, in particular in the USA. For such transfers we rely on standard contractual clauses pursuant to Art. 46 GDPR or comparable safeguards.
3. Hosting and server logs
This website is hosted by Netlify, Inc., 512 2nd Street, Suite 200, San Francisco, CA 94107, USA. Netlify is certified under the EU-US Data Privacy Framework; in addition, the standard contractual clauses pursuant to Art. 46(2)(c) GDPR apply. When the site is accessed, the server processes technically necessary data: browser type and version, operating system, referrer URL, time of the request and IP address. The legal basis is our legitimate interest in secure and error-free delivery (Art. 6(1)(f) GDPR). The site is SSL-encrypted throughout.
4. No cookies, no analytics
This website sets no cookies. We use no advertising trackers, no analytics tools and no advertising networks.
5. Fonts, films and 3D
All fonts, images, films and program components, including the 3D display, are stored on our own web space. Visiting the site creates no connection to third-party servers, in particular not to Google Fonts or video platforms.
6. What your browser remembers
So that the flight into the house does not restart on every page change, your browser remembers for the duration of your visit which rooms you have already entered (sessionStorage). If you switch on contrast, text size or the calm view on the accessibility page, your browser stores this choice locally (localStorage). None of this leaves your device, and you can delete it in your browser at any time.
7. Contact by e-mail, phone and letterbox
When you write to us, call us or use our “Letterbox” form, we process your details (name, contact details, request) in order to answer your enquiry. Messages from the letterbox go straight into our customer system. The legal basis is Art. 6(1)(b) GDPR for pre-contractual enquiries and Art. 6(1)(f) GDPR for other enquiries. We delete the data as soon as they are no longer needed, at the latest after three years, unless statutory retention obligations prevent this.
8. WhatsApp
You can reach us via WhatsApp, a service of WhatsApp Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland (Meta group). In doing so, connection and usage data are transmitted to Meta and may also be processed in the USA. We have no influence over this. The connection is only made when you tap a WhatsApp link. If you prefer not to use WhatsApp, you can reach us by e-mail or phone.
9. Test call with IVI
When you call the IVI test number, the call is recorded and transcribed for the purpose of handling it and checking quality. IVI points this out at the start. Details can be found in the privacy policy on vivyt.ch.
10. Mush Machine and sample request
When you enter a web address into the Mush Machine, our server retrieves this publicly accessible page once and has an AI service (Anthropic, USA) generate a preview from it. Only the web address and the public content of that page are processed. The preview is not stored. To protect against misuse, we count how often the machine runs per IP address in one day. If you request a sample, we store your details (web address, name, e-mail, phone and your ideas) in our customer system in order to create the sample and contact you (Art. 6(1)(b) GDPR). You may request deletion at any time.
11. Data of your website
When creating and maintaining your website, we process the content, texts and images you provide exclusively for the performance of the contract (Art. 6(1)(b) GDPR).
12. Links to other sites
We link to vivyt.ch, viahopro.com, hopro.org and the design samples at designprobe.de. The respective privacy policies apply there.
13. Your rights
You have the right at any time to access (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), objection (Art. 21) and withdrawal of consent with effect for the future (Art. 7(3)). An informal message to datenschutz@viavitalgroup.de is sufficient. You may also lodge a complaint with a data protection supervisory authority (Art. 77 GDPR).
14. Data security
We protect your data with appropriate technical and organisational measures against manipulation, loss, destruction and unauthorised access.
Version: October 2026. We update this policy when new technology, new laws or changes to our site make it necessary.
File 03Terms and conditions for web design
What applies when we build your site.
General terms and conditions for websites by Herzstück Web · Herzhaus Studios LLC · Version: October 2026
1. Scope
These terms apply to all contracts between Herzhaus Studios LLC, 1209 Mountain Rd Pl NE #12733, Albuquerque, New Mexico 87110, USA, trading under the brand “Herzstück Web” (hereinafter “Herzstück Web”), and its clients (hereinafter “client”) for the creation, publication and ongoing maintenance of websites. For advertising, films, graphics, software and the AI voice assistant IVI, the terms of the respective offer apply. Deviating terms of the client only apply if Herzstück Web expressly agrees to them in text form.
2. Conclusion of contract
Offers are non-binding unless expressly designated as binding. The contract is concluded by order confirmation in text form, at the latest when the client approves the website. Oral side agreements require confirmation in text form.
3. Scope of services
Herzstück Web creates an individually designed website for the client, publishes it and maintains it on an ongoing basis. The monthly fee includes in particular: design and build, the writing or refining of texts and images, hosting, SSL security certificate, the technical setup of the legal notice and privacy information, registration with Google, and minor changes. Minor changes are usually handled within 24 hours. No specific economic result, such as visitor numbers, search engine rankings or sales, is owed.
4. Additional services
Major rebuilds, additional subpages or special requests are not part of the monthly fee. They are agreed separately in advance and billed at the stated fixed price. The client always knows the price before work begins.
5. Cooperation and content of the client
The client provides all necessary information, texts, images and access data in good time. The client warrants holding the required rights to all content supplied and that this content does not infringe applicable law or the rights of third parties, and indemnifies Herzstück Web against any third-party claims arising from it. Delays caused by a lack of cooperation are not the responsibility of Herzstück Web.
6. Fees, start of contract and payment
The monthly fee is 25 Swiss francs (CHF) or 27 euros (EUR), depending on the invoicing currency. For online shops and booking sites it starts at 35 euros, as per the offer. As Herzhaus Studios LLC is a foreign company, no German VAT is shown. For consumers these are final prices; for businesses the reverse-charge procedure may apply depending on their registered office.
The contract begins on the first day of the calendar month following publication. If the website goes online on 20 August, for example, the first billing month begins on 1 September; the days until then are free of charge. Payment is made monthly in advance, by bank transfer, credit card or PayPal.
7. Late payment
If the client falls into arrears, Herzstück Web first sends a reminder in text form. If two consecutive monthly fees remain unpaid, Herzstück Web may, after giving notice, temporarily take the website offline until the arrears are settled. The obligation to pay remains, and the website data are not deleted during this time.
8. Term, termination and file package
The contract runs for an indefinite period, with no minimum term. Either party may terminate with one month's notice to the end of a month, in text form; an e-mail or message is sufficient. The right to extraordinary termination for good cause remains unaffected.
During the term, the website remains published on Herzstück Web's servers and is looked after. When the contract ends, publication is discontinued; this incurs no costs. There is no entitlement to the handover of the website files.
If the client wishes to continue running their website with another provider, they receive it as a complete file package (ZIP file), ready for publication. The basis is the creation value stated in the contract of 3,999 to 9,999 Swiss francs (4,299 to 10,799 euros) depending on scope; for particularly extensive work it is agreed individually. Of this, the following is charged: 120 percent in the first contract year, 100 percent after one year, 80 percent after two years, 60 percent after three years, and permanently 20 percent after five years. The decisive factor is the uninterrupted duration of the care plan at the time of the request.
Design and source code are transferred. The client's content, texts, photos, logo and domain belong to the client anyway, at all times. On request, the care plan can continue even after a takeover.
9. Rights of use
Upon full payment of the fees due, the client receives a simple right of use, unlimited in time and place, to the website created for them, including the texts and graphics created specifically for it. Once the client has received the file package under section 8, they may also run and develop the site elsewhere. Rights to tools, templates and general design components that Herzstück Web also uses for others are not transferred.
10. Domain and external costs
The domain belongs to the client and is paid for by the client. On request, Herzstück Web takes care of registration and setup. Other third-party costs, for example for paid images or external services, are borne by the client after prior agreement.
11. Reference mention
After prior consultation, Herzstück Web may show the website it has created as a reference on its own website and in its own materials. The client may revoke this at any time in text form.
12. Availability
Herzstück Web ensures the highest possible continuous availability. Brief interruptions due to maintenance, faults at the hosting provider or events beyond our control do not give rise to any claim for reduction or damages.
13. Liability
Herzstück Web is liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. In the case of slight negligence, Herzstück Web is only liable for breach of essential contractual obligations, limited to the foreseeable damage typical for the contract. Any further liability, in particular for lost profits, indirect damage and consequential damage, is excluded to the extent permitted by law.
14. Force majeure
Events of force majeure, in particular natural disasters, pandemics, official orders, and power, internet or telecommunications outages, release the parties from the obligation to perform for their duration.
15. Final provisions
Swiss law applies exclusively, excluding the CISG. For consumers, the mandatory consumer protection provisions of their country of residence also apply. The place of jurisdiction for disputes with businesses is Chur, Switzerland, to the extent permitted by law. Amendments require text form. Should individual provisions be invalid, the remainder shall remain valid.
File 04Withdrawal
For private customers: fourteen days to think it over.
This notice applies only to consumers, that is, natural persons who conclude the contract for private purposes. Businesses have no right of withdrawal.
Right of withdrawal
You may withdraw from this contract within fourteen days without giving any reason. The period begins on the day the contract is concluded. To exercise your right of withdrawal, inform us (Herzhaus Studios LLC, 1209 Mountain Rd Pl NE #12733, Albuquerque, New Mexico 87110, USA, e-mail: hallo@herzstueck-web.de) by means of a clear statement, for example by e-mail or letter. Sending it in time is sufficient to meet the deadline.
Consequences of withdrawal
If you withdraw, we will refund all payments we have received from you without undue delay and at the latest within fourteen days of receiving your withdrawal, using the same means of payment, unless otherwise agreed.
Early start of work
If you expressly request that we begin work before the withdrawal period has expired, you will pay us a reasonable amount for the services provided up to that point if you withdraw. We will point this out to you separately beforehand and obtain your consent.
